All payments are processed by Stripe, Inc. Your payment information is transmitted directly to and stored by Stripe. BidRise never stores your credit card number, CVV, or full payment details on our servers. By providing payment information, you also agree to Stripe's terms of service available at stripe.com/legal/ssa.
If a scheduled payment fails, we will notify you by email and attempt to retry the charge. If payment cannot be collected after reasonable retry attempts, your account may be downgraded to the Free plan. We will notify you by email before any such downgrade occurs.
You are responsible for all applicable taxes on your subscription. Where required by law, BidRise may collect and remit sales tax on subscriptions. If sales tax applies in your jurisdiction, it will be displayed at checkout before you complete your purchase.
You may cancel your BidRise subscription at any time by following these steps:

You are never required to call a phone number, send an email, write a letter, or contact a customer service representative to cancel your subscription. The cancellation process is no more difficult than the sign-up process.
BidRise does not offer refunds for partial billing periods that have already begun. If you cancel mid-period, you retain access through the end of that period and will not be charged going forward.
Exceptions: Refunds may be granted at our sole discretion for documented technical failures that prevented you from accessing the Service for more than 24 consecutive hours. Refund requests must be submitted within 7 days of the charge in question to billing@bidrise.pro with a description of the issue.

Some states, including New Jersey, Massachusetts, and Missouri, do not allow the exclusion of certain implied warranties or the limitation of certain types of damages in consumer contracts. If the laws of your state of residence apply and do not permit these exclusions or limitations, some or all of the above may not apply to you, and you may have additional legal rights.
You agree to defend, indemnify, and hold harmless BidRise.pro and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
Termination by you: You may cancel your account and terminate your use of the Service at any time through your account settings as described in Section 5. Termination is effective at the end of your current paid billing period.
Termination by BidRise: BidRise may suspend or permanently terminate your access to the Service if you violate these Terms, engage in fraudulent activity, engage in conduct that could harm other users or BidRise, or for any other legitimate business reason. Where reasonably practicable, we will provide advance notice before termination. In cases of serious violations, termination may be immediate and without prior notice.
Effect of termination: Upon termination of your account, your right to access and use the Service immediately ceases. These Terms and any dispute arising out of or related to the Service are governed by the laws of the State of New York and applicable federal law, without regard to New York's conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms. The arbitration shall be conducted:
The following types of claims are excluded from arbitration and may be brought in a court of competent jurisdiction:
YOU AND BIDRISE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. Unless both you and BidRise agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.
Exception for California residents: This class action waiver may not be enforceable as to claims brought under the California Consumers Legal Remedies Act (CLRA) or California Unfair Competition Law (UCL). California residents may have the right to bring such claims on a class basis notwithstanding this waiver.
Either party may bring an individual claim in small claims court in the county of your residence or in New York County, New York, provided the claim qualifies under the applicable small claims court rules and monetary limits.
